1. General conditions

• Eligibility: You must be at least 18 years old or have the consent of a parent or legal guardian to use our services.
• Acceptance: By accessing our site or using our services, you accept these terms. If you do not agree, please discontinue use.
• Changes: We may modify these terms periodically. Your continued use of our services constitutes acceptance of those changes.

2. Service process

SubSell offers three main services: phone buyback, refurbished phone sales, and phone exchange / trade-in.

• Device evaluation: You must provide accurate information about your phone's condition (model, capacity, overall state, battery health, any damage).
• Preliminary quote: Based on the information provided, we offer an initial price estimate, guaranteed for 24 hours.
• Inspection and final quote: Once in-store, our team performs a physical inspection to confirm the condition. Any difference between the description provided and the actual state may lead to a price adjustment.
• Completion: Once the final quote is accepted, we complete the transaction: cash, Interac e-Transfer, or store credit at your choice.

3. Pricing and payment

• Pricing factors: Prices depend on the model, capacity, physical and functional condition, battery health, and current market conditions.
• Payment methods: Cash in-store, Interac e-Transfer, or store credit. All payments are made in Canadian dollars (CAD).
• Adjustments: If the actual condition differs from the information provided, the quote may be revised. If you refuse the new quote, your device will be returned to you in accordance with our policy.

4. Customer responsibilities

• Accurate information: You warrant that all information provided about your device is truthful and complete.
• Device ownership: You confirm that you are the legal owner of the device and that it has not been declared lost or stolen. All devices are verified against the IMEI database before any transaction.
• Data backup: You are responsible for backing up and deleting all your personal data before handing over your device. While we perform a free secure wipe on-site, we are not responsible for any data loss.
• Device unlocking: You must disable all device locks (Find My iPhone, Google account, etc.) before the transaction. A locked device cannot be purchased.

5. Prohibited activities

You agree not to:

• Use our services for any illegal or fraudulent purpose.
• Submit a counterfeit, stolen, or illegally obtained device.
• Disrupt or compromise our website or services.
• Submit falsified information with the intent of obtaining a higher price.

6. Limitation of liability

SubSell is not liable for:

• Loss of data on devices submitted for service.
• Issues related to the use or temporary unavailability of our online services.
• Delays caused by third-party carriers or payment processors.
• Indirect or consequential damages arising from the use of our services.

7. Warranty on refurbished products

• All our refurbished phones are sold with a 6-month warranty covering material and functional defects.
• The warranty does not cover damage caused by drops, liquid contact, or improper use.
• To make a warranty claim, visit the shop in-store with proof of purchase (receipt or confirmation email).

8. SMS Communications and Automation

By submitting a form with your phone number and checking the consent box, you agree to receive transactional SMS messages from SubSell regarding your request. Full details of our SMS program are described in our Privacy Policy, Section 3.

• Type: Transactional messages only (quote, confirmation, pickup).
• Frequency: 1 to 3 messages per request.
• Charges: Standard carrier rates may apply.
• Opt-out: Reply STOP at any time.
• Help: Reply HELP for assistance.
• Privacy: Your data is never shared with third parties.
• Provider: Twilio (Canada) Inc., acting as a data processor compliant with CASL and Quebec Law 25.

9. Privacy and data protection

10. Suspension and termination

We reserve the right to limit, suspend, or refuse to provide our services to any customer who violates these terms or engages in prohibited activities.

11. Governing law

These terms are governed by the laws in force in the province of Quebec and applicable Canadian federal laws. Any dispute will be submitted to the exclusive jurisdiction of the courts of Montreal, Quebec.
